SOCIETY IS STRUCTURED ON IDEAS PART XI By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes on
Here are a listing of materials, FAMILY, ALLY and FRIENDS of the Virginia Prisoner should familiarize themselves with and again as a reminder, these resources are also for our National Bruthas and Sistahs.

OBJECTIVE PUNISHMENT---89 U.CIN.L.REV.628 by ANTHONY M. DILOF DRUGS AND VIOLENCE---88 S.CAL.L.REV.227---by SHIMA BARADARAN [cited in WEIDMAN v. COLVIN 164 F.SUPP.3d 650, UNITED STATES v. FUGITT 2023 U.S. DIST. LEXIS 30319] ETERNAL LAW: THE UNDERPINNING OF DHARMA AND KARMA IN THE JUSTICE SYSTEM----13 RICH. PUB. INT. L .REV. 49 by SHIV NARAYAN PERSAUD A CASE AGAINST THE KANTIAN RETRIBUTIVIST THEORY OF PUNISHMENT: A RESPONSE TO PROFESSOR PUGSLEY---11 HOF. L. R.273 by LEON PERL [this is an important read because it exposes the speculations exploited by minds and hearts who capture elected legislators, despite what an electorate might have voted for or against] THE JURISPRUDENCE OF CRIME AND PUNISHMENT FROM PLATO TO HEGEL---39 . JURN 97 by MATTHEW A. PRULEY [this also deals with the speculations influencing elected legislators unbeknownst to the voting electorate, who assume a politician's position on Justice is organically derived] POSSESSING INTANGIBLES---116 NW. U.L. REV.1226 by JOAO MARINOTTI THE TRIAL OF BIGGER THOMAS: RACE, GENDER, AND TRESPASS---31 N.Y. U REV.L. and SOC.CHANGE 1 by I. BENNETT CAPERS [this work is significant because it exposes the casual-ness of bias. The work is an analysis of Richard Wright's seminal work NATIVE SON and from my point of view all of theses sorts of effort behave as if we are fundamentally clueless as to the nature of the American Justice Infrastructure and the "why". Because we all understand and know the why, yet we act as if what we lack is revelatory insight, when the polemic has been repeated over and over again and again ad nauseam] FAITH HEALING EXCEPTIONS VERSUS PARENS PATRIAE: SOMETHING GOTTA GIVE---10 FIRST AMEND.L.REV. ---692 by REBECCA WILLIAMS [cited in STATE v. NEWMANN 832 N.W.2d 560---WISCONSIN CASE] MAJOR QUESTIONS HYPOCRISY---76 ADMIN.L.REV. 771 by KEVIN O. LESKE [this work is highly relevant because it is speaking to and exposing recent ploys and gambits by the reactionaries on the Supreme Court of The United States and illustrating the necessity for political attentiveness by the electorate, which is what this listing is framing] REVIEWING THE THREE TRUMP APPOINTEES: EX ANTE AND EX POST---1 TEX. A and M.J.L and CIV. GOVERNANCE 431 by JOSH BLACKMAN [this work is actually pathetic because it is caught up and stuck in the mediocrity of Conservativism and Liberalism, which is simply a statement of interest. What I mean by interest is simply this, political-economy is the foundation of society and the Social Contract, so a world view is simply an expression of methods and means employed to secure ones optimal placement within the business of human existence. Conservatism per virtue of its insularity is systemically corrupt, while Liberalism in its efforts at resolving those inevitabilities of the business of human existence, acknowledges the inherent corruption of approximations. American Conservatism can be reduced to the idealistic pursuit of supremacy in all its deviances, while American Liberalism is revealed as a mute, unwilling to provide the necessary critique] ERIE AT EIGHTY: CHOICE OF LAW ACROSS THE DISCIPLINES ERIE AS A WAY OF LIFE---52 AKRON L. REV. 198 by ERNEST A. YOUNG FEDERAL HABEAS CORPUS REVIEW OF NONCONSTITUTIONAL ERRORS: THE COGNIZABILIT Y OF VIOLATIONS OF THE INTERSTATE AGREEMENT ON DETAINERS---83 COLUM L. REV. 975 by CHRISTOPHER D. CERF [cited in FEX v. MICHIGAN 507 U.S. 43 and in 1st,7th and 9th CIRCUIT cases and in two State cases]

"[T]HE CONSTITUTION DOES NOT MANDATE COMFORTABLE PRISONS"-----THE MAJORITY IN RHODES v. CHAPMAN 452 U.S.337 (1981) By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes on
The title to this work is quoted from a "declaration" by the Supreme Court of The United States in 1981.From a law suit filed by Prisoners held at the SOUTHERN OHIO CORRECTIONAL FACILITY, a Maximum Security Prison at Lucasville, Ohio, claiming that the double celling of the tiny cell space, meaning having two prisoners share a small space of 63 square feet, violated the Eighth Amendment to The Constitution, prohibition against CRUEL AND UNUSUAL PUNISHMENT. My focus with this work isn't to critique that 1981 declaration of the Supreme Court, that "the Constitution does not mandate comfortable prisons", but instead to use it to show that as much as we say that the Social Contract or in this case Virginia Society is based on the RULE OF LAW and it doesn't get anymore lawful than the CONSTITUTION. The reality is we are not. The "we are not" aspect isn't that mere and patently simple characterization of the predisposition to violate. Instead it reveals and exposes, that there is an inherent corrupt value in structure. Whether at the conceptual and idea stage to its realization, its negation or that which will undermine it as corruption is there with it. Secondly, (and this affirms and proves the existence of the corrupt value). LAW is an aspirational frame work from which we leverage and critique that which will enable our affirmation of the fundamental and primary BUSINESS OF HUMAN EXISTENCE. In other words, law as Constituted Aspiration, is guide or theory, notwithstanding a salute to BLACK LETTER LAW, if the existence of a status quo and privilege has thought us anything, it has imparted that, that eponymous "norm", is just that, contextually idealistic. I BEGIN: The Constitution of The United States, affirms and prohibits certain concepts. Which we generally refer to as "Rights. "Then it plays the sophist gimmick of other concepts or Rights are left to the People. Notwithstanding the fact that the Constitution is the Supreme Law. Or whatever conceptual framework emanating from it, is defacto fiat, still and despite that fact it squares the circle with The People are sole possessors of whatever the a priori Constitution in its omnipotent Supremacy, is paradoxically silent on. When the Supreme Court declared that the Constitution doesn't mandate comfortable prisons, in 1981 as response to Ohio Prisoner's assertion that subjecting them to imprisonment in an insufferably tiny space, what those Jurist or Judges conveniently didn't say is, nor does the Constitution say Prisoners should be imprisoned under those conditions either. The point is this, ever since the Supreme Court made that declaration, those words have become Law, without any elected legislator saying aye or nay to it. Those words have been used in approximately 1,708 law suits in the 4th Circuit, which the Commonwealth of Virginia is under its jurisdiction. Those words just as all our words comprehensively have a bias, a bias which in the context of a Social Contract, must be unambiguously stated, so it can defend itself. Because as Judge MARSHALL stated in dissent to what his colleagues had done in the RHODES case: "With the rising crime rates of recent years, there has been an alarming tendency towards a simplistic penological philosophy that if we lock the prison doors and throw away the keys, our streets will somehow be safe". People, Judge Thurgood Marshall, had this insight in 1981.Forty-Five years ago ! and here we are in 2026 with Virginia Republicans, who are bereft and bankrupt of what it even means to confront their very own structural corrupt values, regurgitating, the same tired noises against Governor Spanberger, who at least is confronting it.

Law as I've indicated is the Constituted Aspirations of The People. Meaning it exist for the People. Created by the People. Emerging as a contemporaneous symbiosis of Who Are the People with what segment of the People and it's percentage are commanding the status quo presumptive benefit of privilege. This presumptive benefit of privilege, is the materialization of that inherent structural corrupt-value in its anticipatory existence, for the accountability-function of governance, which in principle is energized by the People. However, when the People for any number of reasons and factors are, incapable, unwilling and unable to energize that accountability-function of governance, then, the existing vacuum is filled with and by that presumptive benefit of privilege or in other words, an ad hoc stamp on virtually the very intention of the Constituted Aspirations of Law. Yes its easy then to simply describe the consequence or its result as its crass violation, which it still is. But what is actually occurring (and it is revealing that it appears initially in issues with the Justice Infrastructure and the subsequent Imprisonment Schemes) is an attack, at times consciously and deliberate, but for the most past unconsciously on the expression-medium or idea of the constitution of aspirations, then lastly its purpose or objective. As I initially stated my intention with this work, isn't to indulge in the low hanging fruit of critiquing the ruling of the Supreme Court in RHODES v. CHAPMAN 452 U.S 337, but to show how whether intentionally or not, declarations or speculations by those embodying Governmental functions, which Judges are, negate the very basis of their relative authority as it exist as the fundamental undergirding PROCESS, along with the unforeseen consequence inexorability. What this points to isn't the fact that for example the RHODES majority, mocked the very Constitution they have its authority of defending by interpreting actions in its name are actually such, with their "The Constitution does not mandate comfortable prisons". But what it instead does is (and here is its relevancy to our work of reforming the imprisonment scheme in Virginia), it reminds and reinforces the demand for actual political involvement and activity by The People. Because yes robbed Jurist can render their "declarations", usurping the ayes and nays of elected legislators, but the People with their Speech are the Supreme and Final arbiters of what is law and whether its formulation is representative of their Constituted Aspirations. What this means for the Virginia Family, Ally and Friend of the Virginia Prisoner, is simple and clear cut. A more deliberate, exact, purposeful and organized focus and involvement in Virginia politics. Involvement means developing, supporting and maintaining a level off "SPEECH", that is capable of recognizing that which is specious. When we are being manipulated and fed gimminks and gambits, instead of the accountability-function of governance. Those Ohio Prisoners in 1981, behaved even more responsibly than the relatively non-imprisoned average Ohio citizen, with their simple claim, that double-celling two men in a cramped and tiny cell was a violation of the eighth amendment to the Constitution's prohibition against Cruel and Unusual Punishment. Instead, what we have come to learn is, in the past forty five years since the Supreme Court ignominiously and insidiously reframed and re-characterized, the Ohio Prisoners cruel and unusual punishment allegation and its insinuation of STATE CREATED DANGER into the snide and snarky, "comfortable prisons", thousands of Prisoners who were not sent to Prison to die, whether its prisoner on prisoner violence, or contracting any number of diseases due to the nature of the confinement, have. We see the same thing in Virginia and its time our Speech indicted it.

YES WE'LL QUIBBLE OVER GOVERNOR ABIGAIL SPANBERGER'S RESPONSES TO PRISON ISSUES WHILE RECOGNIZING IT'S HISTORIC NATURE. BUT WHAT WE SHOULDN'T DO IS REMAIN SILENT WHEN SHE IS ATTACKED BY FORCES THAT HAVE ALWAYS BEEN ON THE WRONG SIDE OF ACCOUNTABILITY By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes on

Recently Nick Minock of WJLA 7NEWS attacked Spanberger for actions of Virginia's Parole Board. As I indicated in my initial response to his comments, his motive wasn't that of improving the Parole process with analysis of its reform. Instead his work was about critiquing the Board to break Virginia law, by not granting eligible prisoners Parole, which as a reminder exist to be granted. In other words analysis of Parole isn't from the vantage, why should it be granted, but why shouldn't it. All and everything that is wrong, unjust and compromising in Virginia's Social Contract didn't appear, just because a Democrat, is Virginia's Executive, which Governor Abigail Spanberger is. But rather all that is wrong, unjust and compromising exist in Virginia due to the continuum of the World View contained in the attacks against Spanberger, for the type of Speech her presence, existence and motive-force presents and represents. To what extent Governor Abigail Spanberger is able to course correct the Accountability-Function of governance, is something we can quibble over. But that doesn't mean that her responses as it currently stands to issues of Virginia's imprisonment scheme haven't been historic and we should acknowledge such. In the context that we understand that the work of Prison Reform in Virginia is primarily that of organizing-explanations and exposure of the narrative that has maintained the extra-judicial nature of the imprisonment scheme. In so many words, the work of reform is reclaiming correct word-definitions, pushing back against deliberate machinations, like Nick Minock critiquing the Parole Board to break the law, exposing euphemisms the dehumanizers of the Virginia prisoner deploy in acting out their extra-judicial impulses and above-the-lawism, challenging collaborations between the media and the reactionaries of Virginia's organized-violence, in their quest to propagandize their misdeeds and or sow dis and misinformation. In earlier times, this work required its very own infrastructure. However, considering the current quantitative and qualitative existing mechanisms of exposing the fraudulent narratives of the obstructionist forces, opposed to holding the Virginia prison accountable available to the FAMILY, ALLY and FRIEND. Works by the Nick Minock of the World shouldn't go unchallenged. For one we cannot expect Governor Abigail Spanberger in her official capacity to engage Nick Minock and his insidiousness. For one it doesn't allow those Virginians whose habit is to block out political activity from those elected, to pay attention. An attention they'd have when the debate is held by the averageness of a family member of a Virginia prisoner, with the likes of a Nick Minock. Or the attention that will focus itself if the debate is between the family member of the imprisoned with a survivor-victim of an alleged act a Virginian is convicted of and imprisoned for. Whatever the contours of the debate what it will not be about, is blame and finger pointing, because both survivor-victim and family of the imprisoned are victims. Both are harmed. As such there can be a level of honesty of expressions of how to approach and see Prison Reform in Virginia. Furthermore by speaking out against the attackers of Governor Abigail Spanberger, it allows her to express resolve upon the recognition that there is appeal and support for her efforts. Historically activity family of the imprisoned have engaged in, is complaints to officials, while being silent to the destructive work of a Nick Minock. So SPEAK UP.

I GUESS IT WAS LOW HANGING FRUIT DAY WHEN NICK MINOCK OF WJLA 7NEWS DECIDED TO CRITIQUE VIRGINIA'S PAROLE BOARD TO BREAK THE LAW By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes only
You see People elitism, effrontery, privilege and hypocrisy appears and comes in all sorts of forms, but its most insidious and nefarious guise, is when it struts its corruption, pushing that Animal Farmesque "some animals are more equal than others". Which in this context and the Nick Minockian World View, there is distinction within the accountability-function of the Commonwealth's governance. Or to put it simply opprobrium and sanction exist for certain invidious and select circumstances of the Commonwealth's Social Contract, while others are excused and even flat out told to ignore and break the law. Well the unforseen consequences of such a World View, which I'm sure the Sinclair Media tendency of Mr. Minok's employment along with its Washington Examiner compatriot could care less. Because in their stance do we come to terms with the naked intent of their grasp of the Social Contract and THE LAW. I BEGIN: So on 10/2/26 Mr. Nick Minock the Emmy Award winning Investigative Journalist, in the employ of Sinclair Media surveyed our Universe of business of human existence and decided that the recent activities of Virginia's Parole Board as it complied with Virginia's law with granting the Virginia Prisoner Parole, (which by the way is the one and only singular purpose and raison d' etre of Parole is its grant to the Prisoner), was the most pressing bane which his ferreting investigative prowess had to assiduously illuminate or the entire edifice of Virginia's Social Contract, would months into the historic Administration of Governor Abigail Spanberger crumble, disassemble, implode, (pick your descriptive). But here is the problem with Mr. Minock's work, his critique of the Virginia Parole Board, wasn't that of pursuing its reform because he had insight that it was at dialectical odds with the Constituted Aspirations of the People of the Commonwealth. Instead he was criticizing the Board for doing its job by obeying and complying with Virginia's law. The law exist to release the eligible Prisoner. It doesn't exist to deny Parole but to GRANT it. Whether the Prisoners granted Parole are "worthy" of the laws application, isn't Mr. Minocks purview. Which exactly is the Speech of a Social Contract. For over a 150 years the Commonwealth of Virginia in violation of the terms of its readmission into the Union of the United States, criminally denied the franchise to a demography of the Commonwealth.[see KING v. O'BANNON 817 F. SUPP.3d 354]. Now regardless that the extremism of the World View, contained within Mr. Minock's flailing at the Parole Board, is idealistic there is a juncture where its posturing is exposed as in KING that it's sole claim is to extra-judicialism or in its base form, lawlessness. Because without the law which Mr. Minock shortsightedly decries the Board for complying with and applying there isn't even the circumstance to "even", maintain the indictment of the imprisonment cause of Nick Minock's ire. Furthermore, reminiscently invoking "actions" of the Parole Board under Glenn Youngkin are simply indicative of the lawless nature of Mr. Minock's stance. Because the behavior of the Parole Board under Youngkin was clearly fraudulent. For one, its components were collecting their Virginia tax payer funded six figure pay checks at the blatant expense of not doing their law mandated duties. This political tendency to achieve failed electoral positions by the dictatorship of criticism evidenced by Mr. Minock's work only animates the latent inherent corruption of the Social Contract.

SOCIETY IS STRUCTURED ON IDEAS PART X [THE STATE-CREATED DANGER EXCLUSIVE] By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes only
I BEGIN: This is Part X in this focus on providing the FAMILY, ALLY and FRIENDS of the Virginia Prisoner with information that is intended to enable that necessary grasp and understanding of what we need to come to terms with in order to hold the Virginia Prison Official accountable by subordinating their professional behavior to the accountability-function of the governing WILL of the PEOPLE OF VIRGINIA, because that is what its all about. The authority of the Prison Official comes from the People and its abuse and violation is in turn a rejection of the People, which as ludicrous as the fact of its psychology, "requires" the People to disown their very existence in order for its complicity medium to even exist. What I'm saying is, the presence of Prison Official violations, its above-the-lawism, is a result of Speech or behavior (affirming or absent) of the People. What I want to focus on with Part X of THE IDEAS series, is something that is as primary to the existence and function of Virginia's SOCIAL CONTRACT or the State Purpose as Government, in other words "the obedience of collective agreement" of yup you guessed it THE PEOPLE. And at this juncture I need to stress this, there isn't a relationship, association or interaction existing as SOCIETY that isn't a fact of the obedience of collective agreement, which we are all born into and some of us rise up and examine its terms, because it has frayed and decayed, which is what confronts us with Social Contract. The qualifying title to this Part X is, THE STATE-CREATED DANGER EXCLUSIVE and there isn't a more fundamental acknowledgement, than the State creating DANGER, which also stands as THE SPECIAL-RELATIONSHIP DOCTRINE, which is defined by BLACK'S LAW as: THE PRINCIPLE THAT WHEN A STATE ASSUMES CONTROL OVER A PERSON (AS IN AN INVOLUNTARY HOSPITALIZATION OR CUSTODY),THE STATE HAS AN AFFIRMATIVE DUTY TO PROTECT THAT PERSON AND MAY BE LIABLE FOR HARM INFLICTED ON THE PERSON BY A THIRD PARTY.THIS IS AN EXCEPTION TO THE GENERAL PRINCIPLE PROHIBITING MEMBERS OF THE PUBLIC FROM SUING STATE EMPLOYEES FOR FAILING TO PROTECT THEM FROM THIRD PARTIES---[my cite of Precedent case law DESHANEY v. WINNEBAGO COUNTY DEP'T OF SOCIAL SERVICES 489 U.S 189,case deals with Mother of child who was beaten to retardation by Father, suing Social Services for returning son to father despite likelihood of father abusing son, which is what happened and SUPREME COURT OF UNITED STATES held that SOCIAL SERVICES DIDN'T HAVE DUTY TO PROTECT CHILD] [also see this case TOWN OF CASTLE ROCK v. GONZALEZ 545 U.S 748, this case deals with a Mother of 3 daughters who had a restraining order against the Father not to be no less than 100 yards away from them, the father violated the Order the Mother contacted the Castle Rock cops who literally ignored her. The father kidnapped the 3 daughters and killed them. So the Mother sued and the SUPREME COURT OF THE UNITED STATES ruled that Cops e.t.c do not have a duty to protect anyone] [ the most recent appearance of this logic is in the ruling by the U.S.COURT OF APPEALS FOR THE FIFTH CIRCUIT in the case STERLING v. CITY OF JACKSON 2026 U.S.APP. LEXIS 27560 where the Judges on the 5th Circuit ruled that there isn't a Constitutional Right to "CLEAN WATER", in other words Government can give you contaminated, polluted and toxic water. Their suggestion as recourse is " Political Action". Which is exactly what this work endeavors.] As I get into this, let me state that Virginia has laws that declare the imprisoned Virginian, during the imprisonment as DISABLED.

So, at VIRGINIA CODE 8.01-2 and effectuated at 8.01-9, we see Virginia seeing the imprisoned for the term, as under a DISABILITY, then at 8.01-9, the provision of its security. What this reveals is the formation of "Obligation". Then at VIRGINIA CODE 53.1-223, we see a bit more development of the commonsense of "Obligation", meaning the Commonwealth's begrudging acceptance of the SPECIAL-RELATIONSHIP DOCTRINE, with the RESTRICTION ON SUITS AGAINST PRISONERS. Which is another fact of the Commonwealth's recognition of "Obligation". What these laws reveal and speak to besides the obvious "Obligation", is having responsibility for the unconditional "survivability" of the Virginia prisoner. In other words the Commonwealth in its pursuit of "a" imprisonment scheme cannot "create-danger", within the one and only context of "compromising", LIFE. There isn't any point to belabor, because without LIFE, there isn't any circumstance to either affirm or negate. So we see how flat out insane it is for the Nations Jurisprudence to formulate that the Social Contractual provision of "CLEAN" Water isn't an "inalienable right", that is simply enumerated. When without the contextual petty tyranny of SOCIAL CONTRACT and its acceptance of the necessary existence of "a" SPECIAL-RELATIONSHIP and its "Obligation "inherency, which stands clearly revealed in the character of Prison and the imprisonment scheme. The unencumbered Human existing without Rousseau's archetypal "chains", will secure LIFE ensuring and sustaining "CLEAN" Water with the realized and discovered means of water purification. So why then is this even an issue if not, as dialectic providing us with that necessary cautionary accusatory, "ORGANIZING-EXPLANATORY" Speech, that our traditionally understood relationship with Social Contract or as it concerns this work Virginia Society, is a "Bill of Goods", that yokes us because of our failure to recognize that the entire entity, edifice and STRUCTURE of Society is an expression of IDEAS, which we have a duty to examine and interrogate. Now this examination and interrogation in practice is the Speech of Political Action. In other words backwards and Conservative Political Speech gives us the type of organized-violence or Government that can with a straight face, say the fact of State-Created Danger or providing contaminated, polluted and toxic water to the socio-person, or that Jeffersonian "disposed to suffer", "mankind" keeping their end of the Social Contract bargain. Or structuring and establishing an imprisonment scheme, that is the very definition of STATE-CREATED DANGER, isn't and because of an entire historical construction of suppositions upon suppositions and brain addling mythologies, traditions and idealistic cultural biases, We accept as "preordained" fact. When all we have to do is question as organizing-explanations, which will naturally be and become the Political Action of Progressive Speech. Listed below are some works, which once again are not only for our Virginia context, but also for our National Equals: REVIVING DESHANEY: STATE-CREATED DANGER AND DUE PROCESS FIRST PRINCIPLES---74 Rutgers U.L.Rev.161 by MATTHEW PRITCHARD [cited in two cases EST.OF SOAKI v. ABDELAZIZ 137 F.4 th 969, MURGUIA v. LANGDON 73 F.4th 1103] (this essay has a Conservative and backwards logic) CHALLENGES IN SUBSTANTIVE DUE PROCESS LITIGATION---76 SMU L.Rev.459 by NANCY LEONG (this essay is Conservative with backwards logic. The backwardness and Conservative logic of these sorts of work, is really a relitigation of the Civil War, because MONORE v. PAPE 365 U.S.169, had the "nerve" to apply SECTION 1983 as it was intended, see UNDER COLOR OF WHAT LAW: A RECONSTRUCTED MODEL OF SECTION 1983 LIABILITY--71 Va.L.Rev.499 by ERIC H.ZAGRANS)

WELL FOLKS AN EN BANC RULING BY THE U.S. COURT OF APPEALS FOR THE 5TH CIRCUIT DECLARES THAT THERE ISN'T A "CONSTITUTIONAL" RIGHT TO CLEAN WATER AND HOW DOES IT IMPACT OUR WORK OF VIRGINIA PRISON REFORM By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes only
You know its easy to simply write off the Judges of the 5th Circuit as hapless philistines, caught up in the rip-tide of their idealistic reaction and presumptions, but that would merely be mirroring their intention. On the other hand what their presumptions, which we see in full and complete display, in the matter of STERLING v. CITY OF JACKSON 2026 U.S APP. LEXIS 27560 enable is that neatly ribbon tied, Klieg light lit packaging of all that is bane to our Human Condition with the instruction, that grasping the dialectic is key as the one and only necessary beacon illuminating our path forward. Because without appreciating the dialectic, which despite existence of epochal insidious machinations devoted to its distortions and denial, we would lack that clearly defined and unambiguously uncontrovertible and unimpeachable vantage from which to expose the strawmanesque opposition to our work of Prison Reform. So in accord we recognize the dialectical utility of bigotry in all its reactionary shapes. I BEGIN: On September 4, 2026 an en banc sitting of Judges on the United States Court of Appeals for the Fifth Circuit, affirmed a lower Courts dismissal of claims, presented in Federal Suit by People of The City of Jackson, Mississippi, of STATE-CREATED DANGER, ENDANGERING BODILY INTEGRITY, (and I paraphrase) by providing, "exposing" them to contaminated, polluted and toxic water and their GOVERNMENT AND PUBLIC OFFICIALS SUBSEQUENTLY LYING TO THEM ABOUT THE HARMFUL NATURE OF THE WATER. THE DECLARATION OF INDEPENDENCE, which is the primary lattice and framework of THE CONSTITUTION OF THE UNITED STATES and THE UNIVERSE OF ITS STATUTES, declares: "WE HOLD THESE TRUTHS TO BE SELF-EVIDENT,THAT ALL MEN ARE CREATED EQUAL THAT THEY ARE ENDOWED BY THEIR CREATOR WITH CERTAIN UNALIENABLE RIGHTS THAT AMONG THESE,ARE LIFE,.....",and as such as the above quoted words were being penned, already existing clothed in violation, (see the chattel enslavement of Black People, by penman, Thomas Jefferson) are we finding and encountering its modern and contemporary co-conspirators, continuing the violation in the matter of STERLING v. CITY OF JACKSON 2026 U.S APP.LEXIS 27560,with the pathetically confounding logic that can only be critiqued as fatuous sophistry, that LIFE and the ALIVE STATE and QUALITY can be arrived at, achieved and maintained with "contaminated" and harmful water? Not only do we have the "unalienable rights", directive of LIFE, of the DECLARATION OF INDEPENDENCE, but we have, the proscriptions of amendments to The Constitution, specifically, The Fifth and Fourteenth, stating " No person shall be.....deprived of life....",Again affirming the requisite a priori of LIFE. Yet those en banc Judges of the 5th Circuit apparently like dervishes, like Saint Teresa obedient to no one but the ecstatic consumption of their idealistic presumptions, which even as their own numbers halfheartedly break ranks to dissent,(see DISSENT OF HAYNES,STEWART, HIGGINSON, DOUGLAS and RAMIREZ),as if in a fleeting moment of lucidity, where the dissent, reveals: "I start with what the en banc majority opinion omits. If one were to read only the en banc majority opinion they could be forgiven for misunderstanding Plaintiffs allegations." [People read the entirety of the Opinion and Dissent, you will begin to see what this work of Reform and achieving the Accountability-Function of governance is. Because in Virginia Prisons we are confronted with the same condition the "Free" People of Jackson are faced with].

THE WORK OF REFORM IS MORE THAN EXPOSING THE VIOLATIONS OF THE VIRGINIA PRISON OFFICIAL, BUT PRIMARILY IT'S ABOUT IT'S ORGANIZING-EXPLANATION TO THE PEOPLE OF VIRGINIA By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes only
I BEGIN: How many different ways can we state that the Professional Behavior of the Virginia Prison Official, in its savagery, barbarism and dehumanization is simply a reflection of the basic and fundamental realization of Virginia's Social Contract ?. Of course we can't say it enough, because repetition is the locomotive or engine of understanding and our social comprehension and if there is one intention, where the fruits of repetition are a vital must, its in the Speech or Work of Reform.(Again I need to restate this, when I say "SPEECH", I'm, stating activity or work of Human Existence and Condition in its most qualified, germane, salient and quintessential nature. Now I'll say this there are those who are vehemently against defining human activity as Speech, which I will not waste time and energy expenditure, in exposing their "30 pieces of silver", incentive). What I mean by ORGANIZING-EXPLANATION, is this, there isn't anyone "subject to the jurisdiction thereof", of the Commonwealth of Virginia, daft to the existence of its Social Contract, Contradictions and Antagonisms, otherwise there wouldn't be a sharpening and heightened focus of the mind and self of the socio-person upon interaction with the uniforms of its Organized-Violence. So, the question isn't about the mental-labor of lecturing to the People for the need of "reform", because homeostasis is already accomplishing that, yes the lecturing. What organizing-explanation is the value and expression that to attain homeostatic function without the inflammatory bane of that tyrannical Social Contractual terms of "fight or flight", sharpening and heightened focus demanded upon interaction with the ever present contradictory and antagonistic points of the State, there has to be that "unity" of the People's Speech, resolute in resolving the Antagonism. The Virginia Prison Official is a function of the State or Commonwealth of Virginia. So for the comprehensive purpose of subordinating the Virginia prison official to the Accountability-Function of Virginia's governance, we cannot isolate and sever the professional behavior of the prison official from its nature of function of the State. The Commonwealth of Virginia despite the herculean work done by the violators if its Peoples Will and Constituted Aspirations, is an entity of the People, created and structured by the People and that "subject to the jurisdiction thereof" is its unambiguous and unequivocal fact. What we in our reform Speech cannot do is give the System or Social Contract a pass, by abrogating its responsibility, which is what we do when we personalize the violations of the prison official as if such occurrences are outside of the Social Contract.

VIRGINIA CODE 19.2-11.14 IS NOT ONLY VAGUE IN ITS DEFINITION OF THE VIRGINIA DEPARTMENT OF CORRECTIONS (VADOC) USE OF A.I. (ARTIFICIAL INTELLIGENCE), BUT IT HAS NOT EVEN BEEN TESTED IN COURT By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes only
The Virginia Prison Official and The Virginia Department of Corrections have been using and applying A.I.(Artificial Intelligence) or Machine Learning in its various forms for a while now. But that is not the prompt for this work. What I want to simply stress is without the focus and attention of the People of Virginia on how every and anything are done by the various forces of the States Organized-Violence arrayed in their name claiming and alleging to be functioning in their interest, including the use of A.I., we will once again be confronted with another emergence of Contradictions and Antagonisms to be resolved, even as we are still contending with antagonisms form the 19th Century. So before this baby A.I. grows into that proverbial behemoth 1000 Ib Gorilla, we should compel the necessary transparency of its use by the Virginia Prison Official while there is National attention on it. As it currently stands, the Virginia Department of Corrections has established OPERATING PROCEDURE 435.5--ELECTRONIC TECHNOLOGY SUPERVISION PROGRAM/A.I. ADJACENT SYSTEMS and it has been updated from 2024-2026,having as authority VIRGINIA CODE 19.2-11.14 USE OF ARTIFICIAL INTELLIGENCE-BASED TOOL. The law has the typical verbiage, when Politicians are not too keen on saying what they supposedly are. Which will then need and require Judges in Courts to flesh it out based on actions presented. But most importantly it is an issue to be elevated by the People by making it into a Campaign issue beyond the formulations of the anti-Data Center Speech (and when I say Speech, what I mean is that motive of positive work or "Political Action"). So VADOC's O.P.435.5: Governs ELECTRONIC MONITORING (EM), GPS SATELLITE TRACKING, VOICE RECOGNITION MONITORING, ELECTRONIC MONITORING SOFTWARE ON PERSONAL ELECTRONIC DEVICES (PEDs), [VADOC doesn't describe this capability as A.I., but are Algorithmic surveillance systems, that (a) TRACK MOVEMENT (b) TRIGGER AUTOMATED ALERTS (c) IDENTITY VERIFICATION (d) ENFORCE INCLUSION/EXCLUSION ZONES (e) AUTOMATED SCHEDULE COMPLIANT CHECKS. VADOC's--APPLICATION:1.1 EM- [Telephone based or Transmitter based devices continuously 24/7 monitoring via private vendor systems. Automated alerts for violations (curfew, schedules, zone breaches). Alerts are algorithmically generated by vendor software]. 1.2 GPS MONITORING- [For High Risk cases (see HAMLET v. IRVIN 2024 U.S.DIST. LEXIS 81233 for analysis of VADOC's description of High Risk), Real time satellite tracking, Automated Geofencing (inclusion/exclusion zones) (see CHATERIE v. UNITED STATES 146 S. Ct. 2193 for precedent setting ruling on Geofencing under 4th amendment construction, but isn't necessarily applicable to prison), Automated violation notification-Algorithmic location surveillance, not human].1.3 VOICE RECOGNITION MONITORING--[This is closest to A.I within VADOC's Documented Procedure, Uses voice biometrics to verify identity, compares prisoner, probationer, parolees voice sample to stored templates, Automated compliance checks, Voice biometrics are machine-learning based, even though VADOC does not label it such].1.4 MONITORING SOFTWARE ON PERSONAL ELECTRONIC DEVICES (PED's)--[VADOC can install monitoring software on Phones, Tablets, Computers. Tracking use, log communications, enforce restrictions, generate automated alerts. This is algorithmic surveillance not human]. NOTE: VIRGINIA CODE 19.2-11.14 [USE OF A.I.] Purports to define VADOC's use and application of A.I., however there isn't any transparent, verifiable proof that VADOC is complying. VADOC may use A.I.. or algorithmic tools but cannot make decisions solely based on A.I. outputs. A.I, recommendations must be reviewed, validated by a Human and A.I. outputs can be challenged just as one would evidence in court proceedings.[NOTE: but to what extent does the typical Virginia prisoner, Family, Ally and Friend have the necessary resources to engage in the sort of struggle with the Virginia prison official, if and when it comes to light that the prison official has violated Virginia Code 19.2-11.14 and Operating Procedure 435.5 ?. This conclusion begins to show why the politicization of the issue of the transparency of A.I. use by the Virginia prison official is primarily an electoral and campaign issue and the People of Virginia must compel its relative framing as such by prospective Politicians seeking leadership Speech in the Commonwealth.] Secondly there has been a proposed expansion of Va. Code 19.2-11.14 by HB 1170 presuming a more defined oversight, but to date, the Bill is yet to develop. Thirdly, there hasn't been a clear evidence and indication that the Virginia prison official is deploying A.I.in the prohibited ways of (1) PREDICTIVE RISK ASSESSEMENT, (2) RECIDIVISM PREDICTION [NOTE: There is circumstantial and logical inference, that the infamous and obsequious to reactionary suppositions and politics, former Director of The Virginia Department of Corrections Harold Clarke revealed such a violation, to the Virginia Senate Finance and Appropriations Committee on May 17,2022 with the proffer that "54% of [Virginia] prisoners scheduled for release due to the Earned Sentence Credit law have a medium to high risk of violent recidivism", (my comments on Clarke's assertions are in the work HAROLD CLARKE,DIRECTOR OF VIRGINIA DEPARTMENT OF CORRECTIONS AND THE 54%,which a net search will produce)] (3) PRISONER CLASSIFICATION, (4) DISCIPLINARY SYSTEMS, (5) FACIAL RECOGNITION INSIDE PRISONS, (6) BEHAVIORAL ANALYSIS, (7) CONTRABAND DETECTION, (8) EMAIL e.t.c SCANNING [NOTE: more information can be found at HTTPS://VADOC.GOV./FILES/OPERATING PROCEDURES/400].
THE VIRGINIA PRISON OFFICIAL USE OF A.I. (ARTIFICIAL INTELLIGENCE) and ADJACENT SYSTEMS MUST BE TRANSPARENT TO THE WILL OF THE PEOPLE OF VIRGINIA The case KECK v. COMMONWEALTH 2011 U.S. DIST. LEXIS 115795, revealed what the edge of the probable and possible gratuitous violations of the imprisoned Virginian, as it relates to its opportunity always being present for the Prison employee, whom the People of Virginia have accorded the privilege of performing their wishes of imprisoning their fellow socio-person looks like. Because Donald P. Keck, employed as a Psychology Associate by the Virginia Department of Corrections at its Powhatan Correctional Center, was caught concealing Virginia prisoner information on his work computer. Keck as a human being and socio-person is irrelevant to our work, save to show, evidence and embody our Speech, that the Virginia prison official and the Virginia Department of Corrections as it concerns the application of A.I and it corollaries cannot be allowed to continue on in the antiquated vein of self-policing, because our sensibilities are comprehensively strafed with facts upon facts, not conjecture but events. From Harold Clarke agitating against the Earned Sentence Credits law and the Virginia Peoples wishes, with the enfeebled fear mongering, highly probably generated A.I. hallucinations that 54% of released prisoners would violently reoffend, to the sordid incident of Donald P. Keck malfeasantly squirreling data of the life existence of imprisoned Virginians on a computer through the dehumanization of the Virginia Prisoner by the prison official.

SO YOU FEEL THAT PRISON REFORM IN VIRGINIA IS A JOKE MEANING THE PEOPLE OF VIRGINIA ARE A JOKE By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes only
Recently there was an anonymous comment to my WORD MEANING, work, that and I paraphrase, they agreed with the point I was making, which they claimed to have also been making, then they concluded with prison reform in Virginia is a joke. Now regardless of and besides its mindset and intention, there are certain incontrovertible and unimpeachable facts defining any and all Reform push including that of Virginia's imprisonment scheme. Which irrespective of "intent "expression are irrefutable. In other words if the purpose or intention of the critique is to discredit or demoralize the energy exerted in the push for reform, which the anonymous comment referenced can be in its mold. Or it is evidence of dissatisfaction with the circumstances of the reform formulation and agitation and as such always turns out to be is due to the undisciplined presence of idealistic assumptions and the luxury of taking things for granted. The reality is, just as it is opposing the reform formulation, it is also (and this is where we find its true significance) enabling the emerging contours and definitions of Reform, to stand clearly, revealed pulsating with its undeniable logic. Which in our case is Virginia's imprisonment scheme, to stand revealed in all its practical legitimacy. What I mean by, practical legitimacy, is this: the work of Reform is specifically about introducing and exposing, to the People an exposé narrative of the existence of that which is to be reformed, or in other words a reminder of its history and origin, that is a compromising fallacy of what the People have come to accept, hold and understand not merely as true, but most importantly to be in the interest of their all around realized development. In other words the People upon encountering that inevitability of the critique, or exposé, which the object of reform has forever anticipated and expected would arrive, find themselves naturally existing DIS-ORGANIZED, untethered from the controlling Social Contract suppositions of what they once accepted, defined and tolerated its yoke as Tradition, as truth of existence of socio-personhood. Because it isn't that the Reform Push, is at odds with Social Contract, but Reform's Speech is wrangling clarity and honesty to the word meaning of "interest", which as it concerns our work, Virginia's imprisonment scheme. Meaning Virginia's imprisonment scheme "has" an interest, that is "supposedly" reflective and representative of the Constituted Aspirations of the People of Virginia and the work of reform or the Reform Push, emerges saying, yes, but there are a couple of things we must clear and confront. Because if Virginia's Justice Infrastructure and the Imprisonment scheme speak due to and under the authority of the People, then we have to have the correct definition of the People, which will then lead us to the honesty of the "mission" of the imprisonment scheme, that is in accord with the Constituted Aspirations of the People. Now this is the crux. What I mean is this: As I've described Reform is exposing Speech, or the exposé of history and origin. Which Social Contract interacts with on the terms of "practical legitimacy", or the requisite attention to its intention, purpose and function. Now here is where we meet the mindless context of Virginia's prison reform is a joke anonymous comment, because if "anonymous" is concerned with the work of prison reform, they would find that in Virginia's Governor Abigail Spanberger do we have the historic first of the "Public" acknowledgement for unambiguous prison reform, SO seize it.

YES WE HAVE OUR INDIVIDUAL VIRGINIA IMPRISONMENT SCHEME EXPERIENCES, BUT GOVERNOR ABIGAIL SPANBERGER WITH HER DESCRIPTIVE OF THE VIRGINIA PRISONER AS "LIVING" IS CREATING SPACE FOR THE REALIZATION OF THE ACCOUNTABILITY-FUNCTION OF GOVERNANCE By William Thorpe

What we as Virginia Prisoner's expect of and from those who speak for us, is Firstly the recognition, understanding and grasp of when Political-catalytic space is being created and most importantly, secondly how to then occupy it with the necessary realizing abilities of what it means to reform Virginia's imprisonment scheme by holding the Virginia Prison Official accountable. Every time a non-imprisoned Virginian or person has complained to a Virginia Government element viz the prison official about an experience a Virginia prisoner has been subjected to within the imprisonment scheme, it is an effort and endeavor of reform and a realization of the accountability-function, but and this will sound counterintuitive, but the infrastructure of the imprisonment scheme welcomes it .Because, it doesn't compel it to cease and desist in the offensive behavior, but rather it treats the circumstance of the complaint as a singular and isolated occurrence an insane affirmation of the systems acceptability and not as its inherently alienated and destructive comprehensive character. This isn't unique to imprisonment, but it is a primary and fundamental nature of the super infrastructure of Society or the Social Contract. Where the entire energy of existence of the Social Contract is spent and expended in distracting attention from the fact that the insufferable circumstances of everyday life are not isolated happenstances but inexorable and inevitable consequences and results of its structure and terms of relations and if the imprisonment scheme is a primary component, then it goes to say that, within the imprisonment scheme we will encounter exponential expenditure of distorting energy. What this then means is, the work of subordinating the Virginia Prison Official to the will of the People under the accountability-function dialectic of governance, is primarily that of showing and establishing that the Prison Official's professional behavior of impunity, is not that "dumbing down" narrative of the "bad apple", but is the system behaving as it is intended to. None of this is insight, because too many damn People have died stressing this simple fact. So it isn't that as a People we are historically oblivious and ignorant, to this basic political-economy machination. But as our ancients observed, that due to that ever present Social Contract dialectic and its distorting requirement, which in the absence of an analysis based organized and structured critique. What then happens is, in our individual personification as socio-persons, experiencing, existence as a peered through communal aperture, we begin to grasp that the accepted " life" happenstances are not happenstances after all but systemic outcomes, which only exist because our disclaimers are derided as illegitimate and evidence of moral failings. In other words we are not socio-persons enough that narratives of our existence compel attention. This brings me to Governor Spanberger's recent acknowledgement that and I paraphrase fellow Virginians are living imprisoned in Virginia prisons. As I have noted in earlier works her descriptive, "living", accomplishes the thesis of holding the Virginia Prison official accountable. On two accounts, firstly considering the Virginia Prison official is accountable to her as Executive of the Commonwealth, she cannot then support, endorse and defend the practices of dehumanizing the Virginia prisoner. Secondly and most important the necessary political space now exist for practical Prison reform.

WHEN A VIRGINIA PRISONER IS SUBJECTED TO AN INFRACTION, THE PROCEDURE IS CHARACTERIZED AS AN ADMINISTRATIVE PROCESS, DO YOU REALIZE THE LIFE AND DEATH OF IT? By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes only
So my opposition to the infamous HB 1030 Parole yoke, codified at Virginia Code 53.1-151.1, is well documented in a number of my works. I welcome disagreements and critique from any vantage of any position. Even when the critique is purely simplistic and an exhibition of idealistic indulgence. Because for one if idealistic indulgences weren't, pervasively a social currency, we all would be winged creatures gloriously eternally chanting, instead of profanely revealing our "unqualified interests" and giving them the honest maturity expected of the necessary and inexorable critique of the Social Contract Humanness realizational function. Despite the fact that ,the business of human existence demands and compels gradient analysis, from self-introspection to political-economy examination, it is never welcome belying its unforgiving and merciless necessity and nothing more compels analysis as the work of reforming Virginia's imprisonment scheme. When we speak of Contradictions and Antagonisms, there isn't a vector more rife with both thesis than as it concerns this work, Virginia's imprisonment scheme and when we don't simply acknowledge such as not being the exception but the rule, then the Virginia People in their rank and file premising its Constituted Aspirations, from the Imprisoned Virginian, to Family, Ally, Friends and most importantly those harmed by the imprisoned are comprehensively ill-equipped to pursue the inevitable Reform irrespective of impulse. Whether or not one is cognizant, with the appreciative presence of mind, that Law is being upheld by Virginia's imprisonment scheme or exists in its apathy, the reality is the conditionality of the presumptuousness are nonetheless impactful. Because the presence of impunity and its above-the-lawism, isn't simply isolated to for example a Virginia Prison Official breaking the law in the treatment of an imprisoned Virginian in solitary confinement in any number of Virginia's Koncentration Kamps. But it seeps out, it leaks out, it pervades and permeates Virginia Society via any number of portals that I'll leave to the educated imagination of the reader and it afflicts and affects that basic basis of social interaction, which is the fundamental recognition of the Virginia socio-person. This formulation is what made Governor Abigail Spanberger's recent descriptive of the imprisoned Virginian as "living" so instructive, because in one swoop she critiqued that philosophical dehumanization of the Virginia prisoner practiced by the Virginia prison official, thereby creating that legitimizing space for the anti-dehumanization critique to mature in. But that perspective is not the focus of this current work. This work deals with how the reduction of what are law formulations are summarily transformed into its management as an Administrative Process thereby transforming the lawful prisoner into an unlawful dehumanization. Look at it like this: ask yourself, now why would a Social Contract, transform the HUMAN RIGHTS of the socio-person into CIVIL RIGHTS, well that's the same exact circumstance with the Prisoner. A prisoner is a complete and total creation of law, as such the prisoner as socio-person is the most lawful. But the Prison Official alters the lawfulness of the Prisoner into an extra-judicial entity subject to the ad hoc whimsies of ADMINISTRATION. Under lawfulness and law the Prisoner is beneficiary of actual Process with all its attendant technicalities, penalties and prejudices. Under Administration the prisoner is subject to arbitrary applications and its corruption

NORTH CAROLINA PRISON OFFICIALS SHACKLED A FEMALE PRISONER WHO WAS HAVING A BABY, THE U.S. COURT OF APPEALS FOR THE FOURTH CIRCUIT, WHICH VIRGINIA IS UNDER ITS JURISDICTION---SAID NO, YOU CAN'T DO THAT AND WE COMMEND THEM By William Thorpe

When People in whose authority Systems viz LAW exist and function do the right thing we acknowledge, recognize and even commend them and we have one of those moments in the case: EDWARDS v. WITHERSPOON 2026 U.S APP. LEXIS 27847.Our work is on Virginia's imprisonment scheme, which the U.S. Court of Appeals for the Fourth Circuit has authority over to what extent its circumstances are relatively lawful. The imprisonment scheme of the State of North Carolina, is also under 4th Circuit jurisdiction, so situations in North Carolina are on legal equal footing as Virginia. But besides the jurisdictional relevance, the fact that the professional determinations of a prison official can be expressed in shackling a pregnant Prisoner in labor, underscores, the Speech of our Virginia work. Secondly the work of the Judges in the EDWARDS case, specifically Judges DIAZ, GREGORY and BENJAMIN (who wrote the Opinion) as it stands should be recognized, for providing analysis that is accessible to us all. I BEGIN: The EDWARDS case, not only is it analytically revelatory, but it also indicts. For starters, the case is about a pregnant prisoner having a baby, it also deals with Opioid use and flabbergasting prison bureaucracy as embodied in the Administration of Dehumanization, evidenced in the summary treatment of a female human in labor. It also indicts the hypocrisy of certain noisy Establishment Institutions, of their typical presence and intrusions into all sorts of Social issues by their absence, as nothing more than crass opportunity. We don't find the various Church and "faith" based Groups and Organizations exploiting the Amicus Curiae system with their dictatorial suppositions, which is odd. Because one would think, supporting a Woman who happens to be imprisoned and is being subjected to State practiced dehumanization, its opposition qualifies for Evangelical critique and opprobrium. Yet the critique is not so surprisingly absent. I will let the suspect Organizations speak for themselves without prompt from our work. What I will however say is, certain things are apparent. The suspect Organizations who typically are present in the Amici environment, having everything to say on all sorts of irrelevances, besides pathetic hypocrisy, clearly haven't resolved the honesty of practice of certain of their unambiguous basic tenets and quite frankly that isn't a sin, that's essentially the human condition, the honesty of resolving contradictions. Another thing the EDWARDS case also does, is allow certain "thought" to, firstly expose their existence, then stutter their way into that proverbial, what, "the cat got your tongue?". Because it confronts the sophistry presented in works as: REVISITING THE CRITIQUE OF THOSE WHO UPHELD THE FUGITIVE SLAVE ACT IN THE 1840's AND 50's--58 AM. J. LEGAL HIST. 290 by PETER KARSTEN. Because if we are to accept the defense of Qualified Immunity, which is nothing more than a perpetual end run, which is practically what PETER KARSTEN ask of us in his REVISITING... THE FUGITIVE SLAVE ACT work, which we also encounter in the DISSENT in LEWIS v. CARABALLO 98 F.4th 521, where a 15 year old boy, CAMERON LEWIS was getting his brain bashed in by a Maryland State Trooper and the Maryland Officer raised as defense, that there wasn't any law that said an Officer cannot bash a human being's brain in under the logic of the arrest process. Now PETER KARSTEN in his FUGITIVE SLAVE work didn't couch, it in QUALIFIED IMMUNITY terms yet it is.

WHY THE WORK OF REFORMING VIRGINIA'S IMPRISONMENT SCHEME IS FUNDAMENTALLY ABOUT UNDERSTANDING WORD MEANING By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes only
What if I made the point that there isn't an act People are and have been imprisoned in Virginia for that hasn't been once upon a time and currently, also performed, primarily in the interest of the Commonwealth of Virginia and its Social Contract? Of course, there will be those who will rise up decrying the effrontery and there will be those who will not only attest to the honesty and correctness of the statement, but will defend it with: and that's why we must reform the Accountability-Function of governance by subordinating the levers of State Organized-Violence to it, which Virginia's imprisonment scheme and the foot soldier, Prison Official are principals. The difference between the above-described positions is fundamentally, the grasp and cognition of word meaning. Yes, you're right to recognize that, the dynamic of corruption, or the above-the-lawism of impunity, in its crass form of the "tolerance" of the pursuit and realization of "interests", exerts its latent dictatorial role on our honesty, loyalty and allegiance to word meaning. Still, I respond with disagreements with facts, which are essentially word meanings, are a revelation of the underlying ignorance, which later on maturely emerges as "short sightedness". So, if Virginia Social Contracts' euphemisms, word salads, ill grasped word meanings are in fact the proverbial Windmills of Don Quixote appearing as unassailable and impregnable citadels, then our work of compelling the Accountability-Function of Virginia's governance is to stand on the simple ask that, if our lives as played out in the business of human existence are consequence, then it's time we applied correct definitions of word meaning. I BEGIN: No one disagrees with the word meaning of LAW. The issue or disagreement with it, is its application, with the debate over the application conveniently exploiting to what extent the various values or positions grasp its word meaning and in most cases the application is defaulted to that lack of meaning. So, for Exa analysis of Virginia's imprisonment scheme meaning its reform, goes no further than to what extent, its Creator, LAW is understood. At this juncture I want to use this bit of anecdote as illustration, Ahoto Taysir Mulazim (Harold Carpenter), who has since passed, used to be in the trenches with me in Virginia's Solitary Confinement Koncentration Kamps. He initially came to prison with, I think 5 years and in the course of protesting and resisting violations in Virginia's imprisonment scheme he accumulated additional time. When Ahoto was initially arrested and all of that in the City of Richmond, Virginia, the cops violated his rights as a juvenile by failing to have a Parent or Guardian, present. This wasn't unique to Ahoto, it was almost standard operating cop behavior, to violate parental and guardianship laws of certain Virginia demographic. This was addressed by Virginia's Appellate Courts in a case that came to be known as BAKER'S CLAIM. The result of Baker's Claim was hundreds, if not thousands of Virginia prisoners whose juvenile rights had been violated, were being released from prison. Of course, the status quo didn't like it, but that's not the point, I'm making. Here is the point, Ahoto was recognized as member of the Baker's Claim class. However, he was denied release because of the additional time he had accumulated protesting and resisting the violations of Virginia's imprisonment scheme. Naturally he challenged the denial of release. The Judge hearing the case told Ahoto, that even though his initial imprisonment was illegal, the added sentences weren't as such he'd stay confined. Ahoto's, position was those other charges wouldn't have happened weren't for the illegal imprisonment.

The reason I share this Ahoto anecdote, is to show how LAW as all things human existence and the ensuing Condition is about WORDS and to what extent we grasp and understand. Because when we don't, we are its victim. Virginia's Imprisonment Scheme is supposedly primarily structured on the Words found at VIRGINIA CODE 53.1, Titled as PRISONS AND OTHER METHODS OF CORRECTION. Now the title as all other words contained in it are Law. Because Virginia Prisons, Methods of Correction are and exist as a creation of law. What I'm saying is in itself an entire Universe of meaning, which is the function of Law, till we are able to say okay enough is enough submit to the actual and correct definition. When we don't do this then the double or even triple meaning begins to become a fact, which in turn is also structured on other "facts", which then begins to be accepted and engaged on the terms that it is Tradition, Heritage and Cultural. While doing everything it can to conceal and distort the fact that any and all moments are right and appropriate to challenge its existence and in turn call it to account. So for example Virginia's 53.1, dealing with prisons, begins with Section 53.1-1 DEFINITIONS and it goes on to describe: "As used in this title, unless the context requires a different meaning": [then it goes on to create or breathe legal air on to various terms, that can and will have life and death authority over the imprisoned and free human being by the meaning. Listed among the terms are] ["State Correctional Facility "means any Correctional Center or Correctional Field Unit used for the incarceration of adult offenders established and operated by the Department of Corrections, or operated pursuant to the Corrections Private Services Act (53.1-261 et seq) "State Correctional Facility" includes "penitentiary "whenever used in this title or other titles of the Code.] Now I excerpted this section to show this, what are the names of Red Onion, Wallens Ridge and Sussex all are State Prisons, however Virginia law as dictated in 53.1-1 says nothing about State Prisons instead it includes penitentiary. Now, there are those who'll say, well penitentiary is synonymous with prison. All of that can be true yet law isn't based on synonyms, unless in its definition it includes "and all synonyms". Here is an example people are still fighting over the appearance of commas in the 2d amendment to the Constitution of the United States, meaning, Law is word meaning and grammar. I'm going to these lengths in this work, to show how in a lot of ways we are sabotaged in our work of reforming Virginia's imprisonment scheme due to our participation in the distortion, appropriation, acceptance of misleading word meaning and we see this pertinently in the construction of PAROLE in Virginia's imprisonment scheme. Fundamentally "Parole" is a definition of release from some sort of constraint. As such its process isn't to determine, WHY parole should be granted but why IT SHOULDN'T. Now this is simple word meaning, but we have allowed its reuse and misuse to transform it into its antonym, because we have historically related and reacted to the entire imprisonment scheme from a position of accepting that the dehumanization which we are subjected to is a self-fulfilling, self-affirming proof that as Virginia prisoners we are less than. Instead of it being an empirical articulation that the dehumanization professionally practiced by the Virginia prison official is a testament of their extra-judicial and crass above-the-lawism indulgences, that are defrauding the Constituted Aspirations of The People of Virginia. Everything applied as Virginia's imprisonment scheme is word meaning construct, from a Parole determinations formulating "a" Public Safety rationale to Governor Spanberger's recent "living" descriptive.

SOCIETY IS STRUCTURED ON IDEAS PART IX By William Thorpe

Pictures are taken from the internet and are used for illustrative purposes only
People I trust you are reading and studying some of the works I list in this series. As I'm always emphasizing we are "ruled" and subjects of a line of thinking that is truly alien and quite frankly antithetical to what you the People of Virginia commonly think and presume undergirds the judgement of those you vote as representation. And there isn't an area that is the testing ground of this convoluted line of thinking, than Prison and the Imprisonment scheme. Because in the administration of the American, viz Virginia's imprisonment scheme more than any other expression, is where we encounter this convoluted line of thinking in its most pure and undiluted duplicity and it is borne on the machinations of the IDEA INDUSTRY, who are liege Lords to the Politician and Legislator. It is vital that The People are privy to the product of the IDEA INDUSTRY, which I have been listing in this series, in order to get past the double talk and outright lies employed by those status quo functionaries, which in essence are most of the Politicians. Below, listed are titles of works, I ask we familiarize ourselves with:
UNION AND STATES RIGHTS: SECESSION, 150 YEARS AFTER SUMTER: SECESSION AND BREACH OF COMPACT: THE LAW OF NATURE MEETS THE UNITED STATES CONSTITUTION---45 AKRON L.REV. 405 by STEPHEN C. RADELET [people this is a damn good, excellent and well presented work. It also exposes the fraudulent and hypocritical thought of Virginia Republicans, the author Michael Radelet should be commended and it also underscores the necessity for unconditional analysis in a reform movement. As a last word I want to also echo Mr. Radelet's reminder that backwards and reactionary Virginia Republicans will most definitely try to reinstate the death penalty in Virginia when they again become the legislature majority.] VULNERABILITY AND JUST DESERT: A THEORY OF SENTENCING AND MENTAL ILLNESS----103 J.CRIM.L. and CRIMINOLOGY 147 by E.LEA JOHNSTON The above listed are illustrations of the cogs of Society's engine. Contrary to the pablum we are fed on that extremely long handled spoon, its all about Control and it's Interest.
